Electronic File Disclaimer
Hunter Engineering Inc. (“Hunter Engineering”) provides electronic files for convenience only, subject to the following terms and conditions:
1. No Warranties
Hunter Engineering makes no representations or warranties, express or implied, regarding the accuracy, completeness, or fitness for any particular purpose of the information contained in its electronic files. All electronic files are provided “as is.”2. Limitation of Liability
Hunter Engineering shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of its electronic files. The user assumes all risks associated with such use.3. Compatibility and Security
Hunter Engineering makes no representations regarding the compatibility of the files with any software or systems and does not guarantee that the files are free from computer viruses or other harmful code. The user is solely responsible for scanning and protecting against any such risks.4. Computer-Aided Design Files
Any files created using AutoCAD, Civil 3D, or other electronic drafting software are provided solely as drafting or modeling services. Hunter Engineering neither expresses nor assumes any responsibility for the accuracy, compliance, or constructability of these files. It is the sole responsibility of the contractor or engineer to:- Verify all measurements and dimensions;
- Ensure the design meets all applicable standards and regulations; and
- Obtain proper engineering review and approval before using any files for construction purposes.
5. Official Documents Control
Electronic files are provided solely as a convenience. In the event of any conflict or discrepancy between the electronic files and any sealed, signed, stamped, or hard-copy documents issued by Hunter Engineering, the sealed, signed, stamped, or hard-copy documents shall control.6. Limited Purpose and No Updates
The electronic files are provided only for the specific project for which they were prepared and reflect the status as of the date of transmission. Hunter Engineering has no obligation to update the files or to notify the user of subsequent changes. Use of the files on any other project or for any other purpose is strictly prohibited without prior written consent.7. Indemnification
The user agrees to indemnify and hold Hunter Engineering harmless from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees and court costs) arising from or related to the use of Hunter Engineering’s electronic files.8. Intellectual Property
All design concepts contained in the electronic files are the exclusive copyrighted property of Hunter Engineering. Any unauthorized use, reproduction, or transfer of these design concepts to other projects is strictly prohibited.9. Modification of Files
The user shall not modify, alter, or manipulate the electronic files without prior written consent from Hunter Engineering. Any unauthorized modifications void all warranties and release Hunter Engineering from any related liability.10. Confidentiality
The user agrees to maintain the confidentiality of the electronic files and shall not share, distribute, or transmit them to any third party without prior written authorization from Hunter Engineering. These terms are binding on the original recipient and any subsequent recipients.11. Termination
Hunter Engineering reserves the right to terminate access to electronic files at any time, with or without cause, and without prior notice.12. Severability
If any provision of this disclaimer is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.13. Entire Agreement
This disclaimer constitutes the entire agreement between the parties regarding the use of electronic files and supersedes all prior agreements or understandings.14. Acceptance
Accessing, downloading, opening, or using any electronic files provided by Hunter Engineering (including files transmitted via email or linked from an email signature) constitutes the user’s acceptance of these terms and conditions.
This disclaimer shall be governed by and construed in accordance with the laws of the State of Arizona, State of Colorado, and State of Texas without regard to its conflict-of-laws principles.
